END USER LICENSE AGREEMENT AND TERMS OF USE

Using this Horoscapps Website and/or Application features (Hereinafter: "Software") therein is subject to the provisions of these License Agreement And Terms Of Use (the: "Terms"). Please read these Terms fully and carefully (from time to time, as they may be subject to change), as using the services and/or information included in the Software, and/or performing any action, constitute your consent to all sections of the Terms (if you do not agree with any of the provisions of these terms, please do not use this Software).

General
1. In these Terms, the singular shall imply the plural, and vice versa. Headings are included for ease of reading only, and should not be interpreted as having any other meaning.
2. The Horoscapps Website and/or Application (hereinafter: "the Software") is operated by “Horoscapps” (hereinafter: "Horoscapps"), and intend to provide certain information, analyzes and calculation based on astrologic research.
3. Horoscapps may shut down the Software or change from time to time the Software's structure and appearance or the availability, prices, and purchasing options of services and content provided by the Software, without giving any advance notice. In addition, the information obtained using the Software may not be accurate. For these reasons, no claim, suit or demand will be made against Horoscapps or any of its behalf in this context.
4. The Software and its Materials may not operate properly, be in final form or fully functional, and may contain errors, design flaws or other problems, or may cause non deliberated deletion of data; functionality is also depends on network and computing speed, and other resources availability. Horoscapps does not guarantee that the services provided by the Software will not be interrupted, will be given regularly and continuously without interruptions, and/or will be immune to illegal access to the Software's computers, damages, faults, malfunctions, software, hardware or communication infrastructure errors in the Software and/or that of any of its suppliers, or that it will be not be damaged in any other way, and will not be responsible for any damages, whether direct or indirect, physical illness, mental anguish, etc, caused to the Software user or his/her property as a result thereof.
5. The Software and all related content and services are provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Membership
1. Using the basic features of Horoscapps is free of charge. However, increased functionality or paid periodical memberships (called “Golden Star”, “Silver Star” or “Bronze Star” or any other plans as may be published from time to time) may require payment.
2. In order to use the Software, the user will be required to fill-in basic information such as (but not limited to) full name, e-mail address, phone number, birth day, birth hour, birth place, gender, time zone, residency/domicile state etc. Increased functionality may require further information, such as details of material events and lifeline of the user. Horoscapps cannot, and will not, check or verify the authentication of such information (except for your e-mail address), and by submitting such information user takes all responsibly for its accuracy.
3. Users are responsible for maintaining the confidentiality of account and password information and agree to accept responsibility for all activities that occur under the user’s account or password.
4. Following the Software registration process, some of the user's details will be kept by the Software, in order for him to be able to check them at any time, track the status of his analyzes, and as for some of the kept details – changes or update them. Unless the user chooses otherwise, the registration process constitutes the user's approval for his inclusion in Horoscapps's customer list, and his consent to receive advertisement emails on Products and Services.
5. Periodical memberships (including any updates and changes thereof) shall commence (and calculated) within updating Horoscapps’ systems in that regard, and Horoscapps will make its best efforts to update its systems accordingly within 3 business since due payment.
6. Payments for increased functionality memberships are non-refundable, unless required by applicable law. In the case of on-going periodical automatic renewable memberships, Horoscapps will automatically charge the applicable member’s payment card or redirect to PayPal account for an auto-renewing membership unless such member cancels his/her membership according to the Software terms.
7. A prerequisite for the validity of a purchase is the approval of PayPal or the relevant credit card company of the transaction and the charge. If payments cannot be charged to a credit card or PayPal account, or are otherwise incomplete or not made for any reason, Horoscapps reserves the right, without prior notice, either to suspend or terminate access to the user’s account.
8. Horoscapps may cancel a transaction in case of a clerical error in the product's description and/or price, or if it arises that the transaction was accompanied by illegal activities by the user and/or any third party.
9. Horoscapps reserves the right to cancel and/or to deny any person and/or entity the right to make purchases on the paid features of the Software and/or (in case not paid in advance) to deny the access to any paid or non-paid features of the Software, and is not obligated to provide any explanation for such a decision.
10. Horoscapps, in its sole discretion and without prior notice, reserves the right to add, remove, or make modifications to the features included in particular memberships of the Software at any time. Memberships rates can be modified by a 14 days prior notice.
11. In addition, the customer is entitled to inform Horoscapps at any time of his desire to not automatically renew the on-going periodical subscription that he purchased, in accordance with the provisions of the applicable Law. Notice of non-renew will be done in accordance with the law, and will specify, in writing, the date of its sending, the customer's identification information (username, first and last name, customer number, address) and the date on which he wishes to end the subscription. Said notice must be sent by email: [email protected], from the same email which the customer has been registered with to Horoscapps. The termination of the subscription will go into effect within 3 business days from receiving such termination notice, and the subscription fee and/or part of said fee will not be refunded for the time until the end of said period.
12. Use of the Software is limited to individuals who are at least 18 years old. By registering or using the Software, you confirm that you are 18 years of age or older. If you are under 18, you are not permitted to access, register, or use the Software or its services in any way.
User's Content
1. A user may share, upload, post to, or transmit, display, perform or distribute personal information and content (the: “User Content”). Horoscapps makes its best efforts that such Content may not be reached by any person other than the Horoscapps personnel.
2. Users of the Software are solely responsible for Content they share and for their interactions with other users, including those they collaborate with whether on or off the Site. Horoscapps is not responsible for enforcing Terms or arbitrating, hearing or settling disputes that may arise between users. Horoscapps reserves the right, but has no obligation, to monitor disputes between Users of the Software.
3. Users undertake not to upload or publish in the Software any content that deems to be:
  1. harmful, hateful, vulgar, threatening, abusive, harassing, pornographic, obscene, libelous, or otherwise objectionable;
  2. infringing upon any third party Intellectual Property, including patents, trademarks, trade secrets, copyrights or other proprietary rights of any party;
  3. contradicting applicable law or any contractual or fiduciary relationships;
  4. unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation or commercial solicitation;
  5. contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications or mobile equipment; In addition, the user shall not run and/or execute any external code and/or script upon the Software;
  6. use, deploy, or attempt to deploy any automated systems, scripts, bots, scrapers, or similar technologies to access, collect data from, disrupt, or interfere with the Software or its services;
  7. impersonate any person or entity, or falsely state or otherwise misrepresent themselves or their affiliation with any person or entity;
  8. intimidate or harass another user; or, use or attempt to use another user's account, service or system, or create a false identity on the Software.
4. User acknowledges and approves, that contents that were uploaded by him to the Software may still be used by Horoscapps even after terminating user's account (for research and statistics reasons), without limitation of time, and no claim, suit or demand will be made against Horoscapps in this context. User hereby waives any claims arising from or relating to the exercise by Horoscapps of the rights granted under this section, and will not be compensated for any exercise of the license granted under this section.
Disclaimer For Providing Advisory Information
1. The Software may provide personal advisory information, based on astrological analyzes, such as forecasts, charts, maps, diagrams, graphs, advices, suggestions and recommendations, on several issues like career, finance, personality, relationships, etc. This advisory information intended only to assist users in their personal life. Horoscapps is not a formal advisor, and will not and cannot give accurate advice or diagnosis, and cannot guarantee the completeness, or usefulness of any advisory information given in the Software or in any other media or form. The information and reports generated by the Software should not be interpreted as a substitute for formal consultation, evaluation or treatment. Horoscapps will not be held responsible for any information interpreted as such by any member, user, or other person or entity.
2. Users are responsible for their own way of life, and course of living, and for any personal decisions (whether for themselves or for any other party) they receive through the Software, whether by implementing the Horoscapps’ advices, suggestions and recommendations or not. In Addition, certain information on the Software may refer to physical, mental or emotional health. Horoscapps suggests that individuals who feel they need support, to contact a health or mental health professionals.
3. Horoscapps is not responsible for any loss or damage or any other implications that may result from the information granted in the Software, and Users should acknowledge that they are using the Software and any provided information solely at their own risk, and shall have no claims against Horoscapps or any of its behalf.
Intellectual Property
1. Copyrights, distribution rights, trade secrets, trademarks and all intellectual property of any kind, whether in regard to the design and layout of the Software and/or in regard to its content and provided information and products or any component of such (hereinafter the "Materials"), are Horoscapps's exclusive property, and/or Horoscapps holds the sufficient rights of use from third parties. Some elements of the Materials may originate from third-party providers and, where applicable, are incorporated under proper licensing terms. While such content may remain the intellectual property of its respective copyright holders in accordance with their license terms, any modifications or original additions by Horoscapps are the intellectual property of Horoscapps, where permitted by the applicable license. Using the Software does not give any license and/or right in the Software’s contents and/or part thereof other than specifically indicated herein. No copying and/or duplication and/or distribution and/or publication and/or any commercial use may be made of any part of the Software, whether directly or indirectly, whether in design, code or any other way, without Horoscapps’s prior written approval.
2. Horoscapps provides the Materials under a non-transferable, non-exclusive, license only for the personal use of an individual user. A user is not permitted to use the Material for a commercial mean, or to transfer it to any third party. Any copying, modifying, assignment, transfer, sale, reprinting, sublicensing, publishing, or other distribution of the Materials is prohibited without the prior written consent of Horoscapps. A user may not copy, modify, reverse engineer, translate, port, or make derivative works of the Materials. A user may not sell, assign, lease, rent, sublicense, market, disclose, publish, or transfer the Materials. A user may not derive or attempt to derive the source code or structure of all or any portion of the Materials by reverse engineering, disassembly, decompilation, or any other means. The user will not alter or remove any copyright notice or proprietary legend contained in or on the Materials.
3. The license herein is effective until terminated by user or by Horoscapps. Users' rights under this license will terminate automatically without notice in case a user fails to comply with any of the Terms. Upon termination of the license, user shall cease all use of the Software, and destroy all his copies, full or partial, of it.
4. The name “Horoscapps" and Horoscapps's trademarks (whether registered or not) are all the exclusive property of Horoscapps. No use of these trademarks may be made without receiving Horoscapps's prior written approval.
5. Advertisements presented on the Software, if any, are the property of the advertiser, and therefore, any use of advertisements which constitutes a violation of the advertiser's rights is prohibited.
6. All users must comply with all applicable national and international copyright and similar laws and must not infringe on the rights of others. Horoscapps does not monitor in any manner whether users are complying with those laws or honoring those rights, and is not responsible for protecting the copyright, license or other similar rights of any user.
7. Horoscapps takes the infringement of the intellectual rights of others seriously, and shall take seriously any attempt to use the Software as a means to infringe or harm the intellectual rights of others. Therefore, a user believes that any material on the Software violates any of its Intellectual Property rights, it may send a written notification of such infringement to our Customer Service (email: [email protected]), with the following details:
  1. The complainer identification and contacts.
  2. Full details of such alleged infringement, including an identification of the copyrighted work claimed to have been infringed, and a statement that the complainer is the owner of an exclusive right that is allegedly infringed;
  3. A statement that the complainer has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
  4. A statement that the information in the notification is accurate, and under penalty of perjury.
8. Horoscapps may promptly and without notice suspend and/or terminate file or content exchanges and/or cease user’s access to the Software, if it believes an infringement on rights of others under copyright law or other applicable law may occur.

Confidentiality of the Customer's Personal Details and Data Security
1. In order to maintain the confidentiality of the information provided by the user when using the Software, Horoscapps makes its best efforts according to technical limitations to use advanced data encryption technologies that shall be modifies from time to time according to necessity. In addition to the foregoing, Horoscapps may record IP addresses for actions made in the Software, and if it detects a fraud or scam attempt, it shall report this immediately to the law enforcement authorities. However, Horoscapps may not guarantee full security of the data against any event.
2. Horoscapps undertakes to maintain discreteness in all matters related to the user's personal details. In addition, Horoscapps undertakes not to make any use of the user's personal details, and/or to transfer them to any other entity, without the user's consent, except as necessary in order to process his/her order.
3. Horoscapps shall be permitted to use the user's personal information only for internal requirements and for complaint and/or review inquiries, including by using cookies and data files in User's device. Any desktop user may change his/her browser settings so that the browser will deny all cookies, or warn of cookies it is sent. Any mobile-phone/tablet/mobile device/device user may decline the use of the Application or erase it from his device. However, it should be stated that some parts of the Software and search services may not function properly, or may not function, if the user refuses to receive cookie files.
4. Horoscapps shall not be considered to be breaching any commitment for privacy, or as infringing a user's privacy in regard to any information, which could be used to identify a user or for him to be tracked by another, resulting from the use of electronic means of communication in general, and computer communication specifically.
Exemption from Liability
1. Horoscapps shall not be liable for any personal injury, property or environmental damage, loss, or any damage or expense caused to the user and/or any third party in connection to any action and/or negligence resulting from any use of the Software and/or any implementation of its content and products. Horoscapps shall not be liable for any neglect and/or action, of any kind, which creates any relationship between the user and any third party and/or resulting from such a relationship, even if the user learns of the third party and/or about its sales Software and/or approached the third party and/or the third party's and/or a supplier's Software through a link appearing on the Software.
2. Horoscapps and/or its representative shall not be liable and shall not have to pay, directly or indirectly, any damages, whether direct, indirect, constructive or special, monetary or otherwise, caused to the user or any third party as a result of or due to the use of or reliance on information and/or services appearing in the Software and/or any third party's content, including personal injury, death, property or environmental damage, loss of income and/or prevention of profit caused for any reason.
3. When information and contents are given on the internet, there is a concern that the user's contents may be exposed, viewed and used by other people on the internet, and Horoscapps is not liable for their security and/or for any damage and/or loss and/or expense caused to the user and/or any third party as a result of this. For the avoidance of doubt, it is clarified that Horoscapps shall not be responsible for any damage caused to the user as a result of the use of or reliance on information included in serviced linked to the Software. Horoscapps is not responsible for the contents of those Software or for the data published in them.
4. The publication of user contents on the Software, or the placing of a link in the Software, shall not be interpreted as offers made to a user, as a show of support, encouragement, provocation, solicitation or sponsorship by Horoscapps for those contents and/or services provided by others. Horoscapps is not reviewing the websites that were being linked to, and is not responsible for the content, accuracy, opinions, availability, privacy practices, security, or any other aspects of any third-party websites, platforms, services, or software. Some areas of the Software may contain material that is inappropriate for minors.
5. Without derogating from the foregoing, Horoscapps shall in no case be liable for a damages sum exceeding the price of the monthly subscription fee paid for by the user.
Miscellaneous
1. Horoscapps's computer records regarding the transactions performed through the Software shall constitute prima facie evidence of the correctness of the transactions.
2. Sole and exclusive jurisdiction for all matters related to the use of the Software is given only to the authorized courts in the Tel-Aviv district, and only the laws of the State of Israel shall apply to the use of the Software.
3. If any provision of these Terms is declared invalid or unenforceable, the remaining provisions of the Terms will remain in full force and effect.
4. Notwithstanding the terms and conditions of this Terms, all or any portion of the Software that constitutes third-party software is subject to the terms and conditions of the software license agreement accompanying such third-party software.
5. You hereby waive any and all defenses you may have based on the electronic form of these Terms and the lack of signing by the parties hereto to execute them.
6. Horoscapps may update these Terms at any given time, without any advance notice. By continuing to use the Software after such changes take effect, you agree to be bound by the updated Terms. We encourage you to review them periodically.
